Alexy’s approach (2015, pp. 61-76) to legal interpretative arguments is relevant both in elucidating the link between linguistic argument and the principles of legislative authority, democracy, separation of powers, and the rule of law, and in establishing provisional hierarchies between interpretative arguments.
However, he does not precisely distinguish between the various types of linguistic arguments and genetic arguments, nor does he describe different types of rules about when and how interpretative arguments in general should be used. Pierluigi Chiassoni’s approach, which will be the subject of some of the next posts, fills these gaps.
